    Frequently Asked Questions

    I am a US citizen living in Canada. Do I really have to file US taxes?

    Yes. The US taxes based on citizenship, not residence — you file every year regardless of where you live or where the income was earned. In most cases you will not owe anything, because the foreign earned income exclusion and foreign tax credit offset the Canadian tax you have already paid. The filing is still required.

    I have not filed US taxes in years. How much trouble am I in?

    Usually less than you fear. The IRS Streamlined Filing Compliance Procedures exist for people whose failure to file was not wilful — typically three years of returns and six years of FBARs, with penalties waived.

    How many days can I spend in the US before it affects my taxes?

    The Substantial Presence Test counts this year’s days plus fractions of the previous two. Many snowbirds cross the threshold without realising. Filing form 8840 each year claims the closer connection exception to Canada.

    I sold a US property and 15% was withheld. Can I get it back?

    That is FIRPTA withholding, taken on the gross sale price rather than your gain, so it is usually far more than the actual tax. Recovering the excess means filing a US return.

    What is an FBAR and do I need one?

    It is a report of foreign financial accounts, required if your combined balances exceed $10,000 USD at any point in the year. It is separate from your tax return and the penalties for missing it are steep.
